Batzner's Milwaukee Brewers Game Tickets Giveaway Official Rules - August, 2012

No purchase necessary to enter or to win. A purchase will not increase your chance of winning. Void where prohibited.

Eligibility: This Promotion is open to Wisconsin and Illinois residents who are at least 21 years of age or older at time of entry. Employees and legal dependents of employees of Batzner Pest Management, Inc. (“Sponsor”) and its subsidiaries, affiliates, advertising agencies, and persons living in the same household as such employees are not eligible to participate to win. Subject to all applicable federal, state, local laws and regulations, and is void where prohibited by law.

How to Enter: The Promotion will begin at 8:00 a.m. CST Thursday, July 19, 2012 and end at 11:59 p.m. CST Wednesday August 14, 2012 (“Promotions Period”). Entries must be received by 11:59 p.m. CST August 14, 2012 to be eligible. There are two ways to enter during the Promotions Period:

Method 1: Visit http://www.facebook.com/BatznerPestManagement; click on the "Like" button (if you are already a fan of http://www.facebook.com/BatznerPestManagement, you will not be required to "like" the page again). Follow the links and instructions to complete and submit the entry form, including inputting your name and email address and zip code, and click the "submit" button. You may then return to the Facebook page if you desire. The order of these steps may vary. These steps will enter you in the Promotion and to participate in any Milwaukee Brewers ticket prize drawings. Only one entry per email address is allowed during the Promotion Period unless entry through referral. If you share a special link with a friend and they “like” us and sign up through there, you will receive an extra entry in our grand prize drawing.  Valid Entries must be submitted via the online method as described above. All Entries must be received during the Promotion Period as determined by the computer time on Sponsor’s server. Any attempt by a participant to obtain more than the allowable Entries by using multiple/different e-mail addresses or Facebook accounts, identities or any other online methods will void all of that participant’s entries. During the Promotion Period, there is one (1) way to receive an additional entry.

Method 2: To enter by mail, hand print on a 3" x 5" card: Batzner Pest Management/ Brewers Game Sweepstakes, your name, complete street address, day and evening phone number, date of birth and e-mail, to: Batzner Pest Management, Inc. Attention: Batzner’s Marketing- Brewers Game, 16948 W. Victor Rd, New Berlin, WI 53151. Mail-in entries must be postmarked by August 13, 2012 and received by August 14, 2012. The method of entry does not affect the opportunity to win. Limit one (1) entry per person per day for the entire Promotion Period, regardless of method of entry.

Bonus Promotion: As stated previously, if you share a special link and a friend signs up through there, you will receive an extra entry in our grand prize drawing.  Further, if we receive a predetermined amount of “likes”, we will draw for a bonus set of tickets to a future Milwaukee Brewers home game for those who have entered by method 1 or method 2 described above.   The maximum amount of bonus pairs of tickets given out will be three pairs (ARV: $150) in addition to the grand prize. 

By entering, Participant agrees to comply with these Official Rules including all eligibility requirements. Sponsor reserves the right to verify eligibility of all Participants. Illegible and/or incomplete Entries and Entries submitted by Participants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Sponsor, Administrator and their agents are not responsible for lost, late, or misdirected Entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the Entries. Proof of entering information at website does not constitute proof of delivery or receipt. Sponsor reserves the right to modify the scheduling of the Promotions without prior notification. Use of computer programs, macro, programmed, robotic, automatic and other similar means to enter the Promotions is prohibited and may result in the disqualification of Entries and/or the entrant. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the Entry is submitted. All Entries become the sole property of the Sponsor and will not be acknowledged or returned.

Prizes: Multiple Winners could receive two (2) tickets to a future Milwaukee Brewers Home Game (ARV: $50) for every 25 “likes” we receive, up to three pairs in total (ARV: $150). One set of four second row diamond box tickets will be awarded for the Milwaukee Brewers vs. Chicago Cubs August 20th 7:10pm game at Miller Park along with a preferred parking pass as a “grand prize” (ARV: $370). Winners are solely responsible for the payment of all federal, state, and local taxes or other expenses or costs relating to the prizes not expressly set forth above. The prizes are non-transferable and may not be redeemed for cash value or exchanged for any other prize. Prizes are subject to availability and Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion.

Winner Selection, Notification, and Acceptance: Odds of winning depend on number of eligible entries received. All Winners will be notified before each home game (listed on brewers.com) at the email address provided on the winner’s entry form within 24 hours. Sponsor will email during regular business hours. Failure to reach the winner by email after two attempts may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. To claim prize, winner must personally visit Sponsor’s office within five (5) business days after notification (office visits must be between the hours of 7:30 a.m. CST and 4:00 p.m. CST weekdays), but before event date, and present a valid photo identification. Winners may waive their right to receive prizes.

Miscellaneous: Acceptance of prize constitutes permission for Batzner Pest Management, Inc. and its designees to use winner's name, city and state of residence and likeness for advertising and promotional purposes in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Winners will be notified by e-mail or phone.  There will be three attempts within 24 hours to contact the winner.  If the winner does not respond and/or pick up the prize, a runner-up will be chosen.  Winners must come to Batzner Pest Management to pick up the prize at 16948 West Victor Road New Berlin, WI 53151.  Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, broadcast, or otherwise display or use entries in any way it sees fit without limitations, compensation, or notification to entrants. By participating, entrants agree to (i) be bound by the terms of these Official Rules and the decisions of Batzner Pest Management, Inc., which shall be final and binding on all matters; and (ii) release and hold harmless Batzner Pest Management, Inc. and all of their respective employees from any and all liability or any injuries, loss or damage of any kind arising, in whole or in part, directly or indirectly, from or in connection with this promotion or the acceptance or use of any prize. Batzner Pest Management, Inc. also reserves the right, at its sole discretion, to disqualify any individual (and void all associated entries) who tampers with the entry process or who is otherwise in violation of these Official Rules, or or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Caution: Any attempt by an entrant or any other individual to deliberately damage Facebook or any website related to the promotion or undermine the legitimate operation of the promotion is a violation of the contest rules and of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any individual to the fullest extent permitted by law.

Indemnity and Release of Facebook: You acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. The information you provide will only be used for the Promotion. You agree to release Facebook from all liability relating to this promotion. You will indemnify and hold Facebook harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) for any claim related to the promotion including without limitation the publicity or administration thereof.

Disputes: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually, without resorting to any form of class action, and any judicial proceedings shall take place in a federal or state court within the State of Wisconsin; 2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the promotion, shall be governed by, and construed in accordance with the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law, rules or provisions (whether of the State of Wisconsin, or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Wisconsin. IN NO EVENT SHALL SPONSOR OR ITS RELATED ENTITIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO ANY INDIVIDUAL ENTRANT IN THIS GIVEAWAY.

Privacy Policy: The information entrants provide in connection with this Promotion will be provided to Sponsor, not Facebook and shall be subject to Sponsor’s privacy policy (the "Privacy Policy") which can be found at http://www.Batzner.com. The information Sponsor collects during this Promotion shall be treated as set forth in the Privacy Policy.
